By accessing and using Premis.my and Premis.com.my (hereinafter referred to as "the Platform"), you agree to be bound by these terms and conditions. These terms govern your use of our property listing software-as-a-service (SaaS) platform.

2. Definitions

• "Platform" refers to Premis.my and Premis.com.my websites and associated services
• "User" refers to property owners, agents, and any individual accessing the Platform
• "Listing" refers to property advertisements posted on the Platform
• "Services" refers to the SaaS solutions provided through the Platform

3. User Registration and Account Security

• Users must provide accurate, current, and complete information during registration
• Users are responsible for maintaining the confidentiality of their account credentials
• Users must notify us immediately of any unauthorized access to their account
• We reserve the right to suspend or terminate accounts that violate these terms

4. Property Listing Rules

• All property listings must be accurate and comply with local real estate laws
• Users must have legal authority to list properties
• Duplicate listings are prohibited
• False or misleading information is strictly prohibited
• We reserve the right to remove non-compliant listings

5. Intellectual Property

The transfer of title, for a consideration, of any property information, including property on which information has been recorded or incorporated, is subject to our terms. Users retain rights to their content, but grant us license to process, display, and modify such content as needed for the Platform's operation.

6. Data Processing and Privacy

Data processing includes developing and maintaining information from data furnished by users. This includes summarizing, computing, extracting, sorting, and sequencing of information. We maintain continuous files of information provided by users on our platform.

7. Service Availability and Maintenance

We provide maintenance services that include:

• System improvements and error corrections
• Backup services to ensure data preservation
• Telephone and online consultation services

8. Payment Terms

• All fees are payable in advance
• Subscription renewals are automatic unless cancelled
• We reserve the right to modify pricing with notice
• No refunds for partial period cancellations

9. User Content and Conduct

Users must adhere to platform guidelines when posting content. This includes maintaining clean, orderly, and functional listings. Users are responsible for the maintenance and accuracy of their listings, including property details, images, and descriptions.

10. Limitation of Liability

We are not liable for:

• Accuracy of user-provided information
• Disputes between users
• Property transactions conducted outside the platform
• Service interruptions or technical issues
• Indirect or consequential damages

11. Termination

You agree that by using the platform, your access may be terminated if you violate these terms. Upon termination, you must cease all use of the platform.

12. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the platform constitutes acceptance of modified terms.

13. Dispute Resolution

All disputes shall be resolved through:

• Initial good faith negotiation
• Mediation if necessary
• Binding arbitration as a last resort

14. Governing Law

These terms are governed by Malaysian law, without regard to conflict of law principles.
